TERMS OF SERVICE
This page explains the terms by which you may use Rovemarket’s (“Rove”, “us”, “our”) online and/or mobile services, website, and software provided on or in connection with the service (collectively the "Service"). By installing, accessing, or using the Service, or by checking a box or clicking a button signifying your assent to these terms, you signify that you have read, understood, and agree to be bound by this Terms of Use Agreement ("Agreement") and to the collection and use of your information as set forth in the Rove Privacy Policy, whether or not you are a registered user of our Service. Rove reserves the right to modify these terms and will provide notice of these changes as described below. This Agreement applies to all visitors, users, and others who access the Service ("Users").
Please read this Agreement carefully to ensure that you understand each provision. This Agreement contains a mandatory individual arbitration and class action/jury trial waiver provision that requires the use of arbitration on an individual basis to resolve disputes, rather than jury trials or class actions.
1. USE OF ROVEMARKET’S SERVICES
A. Eligibility
This is a contract between you and Rovemarket. You must read and agree to these terms before using the Service. You may use the Service only if you can form a binding contract with Rovemarket, in compliance with this Agreement and all applicable local, state, national, and international laws, rules and regulations. This service is strictly prohibited to anyone under the legal age of 13, and if you are between the ages of 13 and 17, you represent that your legal guardian has reviewed and agreed to this Agreement on your behalf.
B. Service
Subject to the terms and conditions of this Agreement, you are hereby granted a non-exclusive, limited, non-transferable, freely revocable license to use the Service for your non-commercializable, personal use only and as permitted by the features of the Service. Rovemarket reserves all rights not expressly granted herein in the Service and the Rovemarket Content (as defined below). Rovemarket may terminate this license at any time for any reason or no reason.
C. Your Account On The Service
Your Service account gives you access to the services and functionality that we may establish and maintain from time to time and at our sole discretion. By connecting to the Service with a third-party service, you give us permission to access and use your information from that service as permitted by that service, and to store your log-in credentials for that service.
When creating your account, you must provide accurate and complete information, and you must keep this information up to date. You are solely responsible for the activity that occurs on your account, and you must keep your account password secure. We encourage you to use "strong" passwords (passwords with a combination of upper and lower case letters, numbers and symbols) with your account. You must notify Rovemarket immediately of any breach of security or unauthorized use of your account. Rovemarket will not be liable for any losses caused by any unauthorized use of your account.
When creating your account regarding the Service, you are prohibited from using politically sensitive, pornographic or any other inappropriate word, symbol or image in your account. It is in Rovemarket’s sole discretion to censor and decide whether the content of your account is prohibited and we are entitled to promptly cancel, suspend or nullify your account depending on the content in your account.
By providing us your email address, you consent to receive Service-related notices, including any notices required by law. We may also use your email address to send you other messages, such as changes to features of the Service and special offers. You may opt out or change your preferences.
D. Service Rules
Rovemarket may, without prior notice, change or stop providing the Service or features of the Service, to you or to Users generally; or create usage limits for the Service. Rove may also permanently or temporarily terminate or suspend your access to the Service without notice and liability for any reason, including if in our sole determination you violate any provision of this Agreement, or for no reason. You agree that upon termination for any reason or no reason, that you continue to be bound by this Agreement.
2. HOMESHOP LICENSE
By registering as a Homeshop (“you”), you agree and understand that you are using the Service as a platform to offer goods and services to customers. You shall not represent being an employee, staff, or an agent of Rove, and anything sold, goods or services, physical or virtual, are not to be deemed to be provided by Rove. Rove shall not be responsible for reporting your tax as legally required.
You understand that by using the Service to offer any kind of goods or services, not limited to physical or virtual goods or services, you will provide the relevant certification/license to handle, sell or create the things or services you offer, and will only use the Service for their intended and lawful purposes.
You also agree to provide at least a 7 (“seven”) day’s notice to close a Homeshop account at our Service, and to continue to be bound by this agreement after closing down any/all of your accounts in any Service provided by Rovemarket.
3. DELIVERY PARTNER LICENSE
By registering as a Delivery Partner (“you”), you agree to only use the Service for their intended and lawful purposes.
Rove does not employ Delivery Partners as part of Rove in any way; staff, employee, nor agent. Rove merely provides a platform for Delivery Partners to link them with consumers and homeshops. Rove is not responsible for the acts and/or omissions of any partner, and any liability in relation to such services will be borne by the Delivery Partner. Rove shall be not responsible for reporting your tax as legally required.
Delivery Partners shall not represent being an employee, staff, or an agent of Rove, and the delivery service provided by the Delivery Partners are not to be deemed to be provided by Rove.
4. OUR PROPRIETARY RIGHTS
The Service and all materials therein or transferred thereby, including, without limitation, software, images, text, graphics, illustrations, logos, patents, trademarks, copyrights, photographs, audio, videos, music, titles, software code, themes, objects, phrases, concepts, artwork, animations, sounds, musical compositions, audiovisual effects, methods of operation, moral rights, documentation, and all Intellectual Property Rights related thereto, are the exclusive property of Rovemarket and its licensors.
Nothing in this Agreement shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to license, sell, rent, modify, distribute, copy, transmit, reproduce publicly display or perform, publish, adapt, edit, or create derivative works from any of Rovemarket’s Intellectual Property. Use of the Rovemarket Content for any purpose not permitted by this Agreement is strictly prohibited.
5. OUR PROPERTY
You understand and agree that you do not possess any rights of access or rights to data stored by or on behalf of Rovemarket. You agree that Rovemarket has the absolute right to manage, regulate, control, modify and/or eliminate Rovemarket Intellectual Property as it sees fit in its sole discretion, in any general or specific case, and that Rovemarket will have no liability to you based on its exercise of such right. You understand and agree that any data, account history and account content residing on Rovemarket's servers, may be deleted, altered, moved or transferred at any time for any reason in Rovemarket's sole discretion, with or without notice and with no liability of any kind.
6. PRIVACY
You understand that by using any of our Services, you consent to the collection, use and disclosure of your personal information and data as set forth in our Privacy Policy, and to have your data collected, used, and stored.
7. SECURITY
Rovemarket cares about the security of your information and uses commercially reasonable physical, administrative, and technological safeguards to preserve the integrity and security of all information we collect and that we share with our service providers. However, no security system is completely safe and we cannot guarantee the security of our systems as absolutely secure. Whenever you reveal any personal information or data to Rovemarket, please keep this in mind. In the event that any information under our control is compromised as a result of a breach of security, we will take reasonable steps to investigate the situation and where appropriate, notify those individuals whose information may have been compromised and take other steps, in accordance with any applicable laws and regulations.
Your information collected through our Service may be stored and processed in Australia or any other country or region in which Rovemarket or its subsidiaries, affiliates or service providers maintain facilities. Administrative, technological, and data security procedures intended to protect private information have been adopted by Rovemarket.
10. DMCA
It is Rovemarket’s policy to respond to alleged infringement notices that comply with the Digital Millennium Copyright Act of 1998 ("DMCA"). If you believe that your copyrighted property has been copied in a way that constitutes copyright infringement and is accessible via any of Rovemarket’s Services, please notify Rovemarket.
For your complaint to be valid under the DMCA, you must provide all of the following information:

A description of the copyrighted work or other intellectual property that you claim has been infringed;

A description of where the material that you claim is infringing is located on the Site;

An address, telephone number, and email address where we can contact you and, if different, an email address where the alleged infringing party, if not Rovemarket, can contact you;

A statement that you have a good-faith belief that the use is not authorized by the copyright owner or other intellectual property rights owner, by its agent, or by law;

A statement by you under penalty of perjury that the information in your notice is accurate and that you are the copyright or intellectual property owner or are authorized to act on the owner's behalf;

An electronic or physical signature of a person authorized to act on behalf of the copyright owner.
11. THIRD-PARTY LINKS AND INFORMATION
The Services may consist of links to other websites that are not directly run by Rovemarket. The websites are not within the control of Rovemarket and Rovemarket is not responsible for their privacy policies or acts. If the customer gives their personal details through any third-party website, it is highly advised for the customer to recognise these privacy policies and acts of the third party.
12. INDEMNITY
You agree to defend, indemnify and hold harmless all of Rovemarket’s personnel, all its affiliates, and their employees against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of the Service, including any data or content transmitted or received by you; (ii) your violation of any term of this Agreement, including without limitation your breach of any of the representations and warranties above; (iii) your violation of any third-party right, including any right of privacy or Intellectual Property Rights without any limitation; (iv) your violation of any applicable law, rule or regulation; (v) Any content that is submitted via your account including misleading, false, prohibited, or inaccurate information without any limit; (vi) your willful misconduct; or (vii) any other party's access and use of the Service with your security credentials.
13. DISCLAIMER - NO WARRANTY
The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable law, the Service is provided without warranties of any kind, whether express or implied. Any content accessed through the use of the Service is viewed at your own risk and you will be solely responsible for any damage to your electronic device or loss of data that results from your use of the Service.
Rovemarket does not warrant, endorse, guarantee, or assume responsibility for any product or service advertised or offered by a third party through the Service or any hyperlinked website or service.
14. LIABILITY LIMITATION
To the maximum extent permitted by applicable law, in no event shall Rove, its affiliates, agents, directors, employees, suppliers and/or licensors be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, this service. Under no circumstances will Rove be responsible for any damage, loss or injury resulting from hacking, tampering or other unauthorized access or use of the Service or your account or the information contained therein.
To the maximum extent permitted by applicable law, Rove assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our service; (iii) any unauthorized access to or use of our secure servers and/or any and all personal information stored therein; (iv) any interruption or cessation of transmission to or from the Service; (v) any bugs, viruses, trojan horses, or the like that may be transmitted to or through our service by any third party; (vi) any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Service; and/or (vii) defamatory, offensive, or illegal conduct of any third party.
15. UPDATES TO THIS POLICY
From period to period, our services can alter. As a consequence, we retain the right without advance notification to amend or change this Privacy Policy at any time and from period to period. We will inform you by email, at the email address you have given to us if we undertake any significant changes to the way we use or reveal your private details. You must stop using our services if you disagree with any amendments. Please kindly check this privacy policy by visiting this website periodically. If you actively use or continue to use our services after some changes or alterations are made, it will imply that you have agreed with the changes in the privacy policy.
